Terms of Service

1. Parties and Acceptance

These Terms of Service (“Terms”) form a legally binding agreement between HR Konnect (ABN 62 463 579 168), a business name registered in New South Wales, Australia (“HR Konnect”, “we”, “us”), and the organisation or individual accessing or using the Service (“you”, “Customer”).

By creating an account or using the Service, you confirm that you have the authority to bind your organisation to these Terms and that you agree to be bound by them. If you do not agree, do not use the Service.

2. Description of Service

HR Konnect is a cloud-based Human Resource Information System (HRIS) for Australian small and medium businesses. The Service includes:

  • Employee records, org chart, and department management
  • Onboarding workflows, reference checks, and bulk employee import
  • Leave management and accrual tracking (Fair Work–aligned)
  • Timesheet submission, approval, and period locks
  • Shift rostering and scheduling
  • Education tools for schools and early learning — casual relief teacher (CRT) rostering, a term-aware calendar, and child-safe recruitment with referee checks
  • HR document management with expiry tracking
  • Training and certification tracking
  • Announcements and direct employee messaging with email delivery
  • Executive HR and CFO reporting dashboards — headcount, workforce cost, and leave and long-service-leave liability
  • Payroll evidence packs and compliance export
  • Full audit trail and HR reporting
  • Manager action centre and employee self-service portal
  • Third-party payroll integrations (Xero Payroll AU; others as released)
  • Offboarding workflows

Features may be added, changed, or discontinued as the platform evolves. We will provide reasonable notice of material changes to the Service.

3. Free Trial

New accounts are eligible for a 30-day free trial of the Service. No credit card is required to start a trial.

  • The trial begins on the date your account is created
  • Full platform features are available during the trial period
  • At the end of the trial, you may choose to subscribe or cancel
  • If you do not subscribe, your account will be suspended and your data retained for 30 days before being deleted
  • Use of the Service during the trial is subject to these Terms

We reserve the right to limit or revoke trial access in cases of abuse or where the trial is being used in a manner inconsistent with these Terms.

4. Subscription and Billing

Paid subscriptions are offered on a per-employee, per-month basis across SMB, Growth, and Enterprise plan tiers as described on the pricing page.

  • Billing is monthly in arrears unless otherwise agreed in writing
  • All prices are in Australian dollars (AUD) and are exclusive of GST unless stated otherwise
  • GST at the current rate (10%) will be added to all invoices issued to Australian customers
  • Employee headcount is calculated based on active employees at the billing date
  • You may cancel your subscription at any time; the cancellation takes effect at the end of the current billing cycle
  • Downgrades to a lower plan tier take effect at the next billing cycle
  • We reserve the right to suspend access for accounts with overdue invoices after providing 7 days’ written notice

5. Data Ownership and Processing

You retain full ownership of all HR data you upload or generate through the Service (“Customer Data”). HR Konnect does not sell your data. We process Customer Data solely to provide the Service in accordance with your instructions and our Privacy Policy (see link below).

You are responsible for ensuring that your use of the Service complies with applicable Australian privacy laws, including your obligations as an employer handling employee personal information under the Privacy Act 1988 (Cth).

6. Data Storage

Our primary database is hosted on Neon PostgreSQL in Sydney, Australia (AWS ap-southeast-2 region). The application is served from Vercel’s Sydney (syd1) region. File storage uses Cloudflare R2 with Oceania region (OC), covering Australia and the Pacific. We take reasonable steps to keep data within Australia.

7. Data Export and Portability on Cancellation

You may request a full export of your organisation’s HR data at any time from within the platform or by contacting us. Exports are provided in standard formats (CSV, PDF).

On cancellation or account closure, we will retain your data for 30 days during which you may request an export. After 30 days, data will be deleted in accordance with our data retention obligations. We will respond to export requests within 5 business days.

8. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable Australian law
  • Upload malicious content, malware, or content that infringes third-party intellectual property
  • Attempt to gain unauthorised access to any part of the Service or another customer’s data
  • Reverse engineer, decompile, or create derivative works from the Service
  • Resell, sublicense, or white-label the Service without written permission
  • Use the Service to process data for organisations other than your own without agreement

HR Konnect reserves the right to suspend or terminate accounts that violate these Terms, with or without prior notice depending on the severity of the breach.

9. Intellectual Property

The Service, including its software, design, interface, and content (excluding Customer Data), is the intellectual property of HR Konnect or its licensors. Nothing in these Terms grants you any ownership rights in the Service or HR Konnect’s intellectual property.

We may use aggregated, de-identified usage data to improve the Service. We will never identify your organisation or employees in any such use.

10. Warranty Disclaimer

The Service is provided “as is” and “as available” without warranty of any kind, express or implied, to the extent permitted by Australian law. HR Konnect does not warrant that the Service will be uninterrupted, error-free, or free from viruses or other harmful components.

Nothing in these Terms excludes, restricts, or modifies any guarantee, right, or remedy conferred on you by the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) that cannot be excluded, restricted, or modified by agreement.

11. Limitation of Liability

To the maximum extent permitted by Australian law (including the Australian Consumer Law), HR Konnect’s aggregate liability to you for any claim arising from or related to the Service is limited to the total fees paid by you in the 12 months immediately preceding the claim.

HR Konnect is not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, loss of data, or business interruption, even if advised of the possibility of such damages.

12. Confidentiality

Each party agrees to keep confidential the non-public information of the other party disclosed in connection with the Service, and to use it only to fulfil obligations under these Terms. This obligation does not apply to information that is or becomes publicly available through no fault of the receiving party, or that is required to be disclosed by law.

13. Governing Law and Disputes

These Terms are governed by the laws of New South Wales, Australia. The parties submit to the exclusive jurisdiction of the courts of New South Wales for any dispute arising from these Terms or the Service, without limiting your rights under the Australian Consumer Law.

Before commencing legal proceedings, the parties agree to attempt resolution through good-faith negotiation for a period of 30 days from the date one party notifies the other of a dispute.

14. Changes to These Terms

We may update these Terms from time to time. We will notify you by email at least 14 days before material changes take effect. Continued use of the Service after the effective date constitutes your acceptance of the updated Terms.

If you do not agree to material changes, you may cancel your subscription before the effective date and request an export of your data.
